Hoffman Estates DUI Issues

Posted by John Callahan | Feb 23, 2016 | 0 Comments

A DUI arrest from Hoffman Estates in the northwest suburbs of Chicago is typically a Class A misdemeanor.  These DUI arrests are brought to the Third District Cook County Courthouse and are prosecuted by the Cook County State's attorneys office.

If you have been arrested for a DUI in Hoffman Estates or Streamwood, Illinois you should know that the Illinois Secretary of State will try to suspend your driver's license from anywhere between 6 months and 3 years, depending on if the Secretary of State treats you as a first offender.  The most important thing you can do to help yourself and prevent the suspension from going into effect is to attack the suspension by filing a petition to rescind the statutory summary suspension right after you are arrested for the DUI.

The criminal charge of DUI can also be attacked but more patience is advised in this area.  There is no rush in contesting the criminal DUI charge.  Evidence can be obtained to help you obtain a successful result sometimes by challenging the stop or breath calibration.
